ACCEPTANCE OF AGREEMENT
You agree to the terms and conditions outlined in this Terms of Use Agreement ("Agreement") with respect to our Site. This Agreement constitutes the entire and only agreement between RCI Pacific Pty Ltd and its associated companies ("RCI") and you with respect to the Site and supersedes all prior or contemporaneous agreements, representations, warranties and understandings with respect to the Site, the content, products or services provided by or through the Site, and the subject matter of this Agreement. This Agreement may be amended at any time by us from time to time without specific notice to you. The latest Agreement will be posted on the Site, and you must review this Agreement prior to using the Site.

MEMBERSHIP VALIDITY
bigredholidays.com membership is valid for twelve (12) months from the date of membership sign-up. However, RCI reserves the right to terminate your membership at any time for any reason at RCI's sole discretion. Applicable fees may apply. Any amendments or additions to the bigredholidays.com membership will be advised.

USE OF WEBSITE
Your use of the Site is subject to the following terms of use. RCI authorises you to view, print or download any content, graphic, form or document from the Site for your personal, non-commercial use and you must not change or delete any such material or copyright notice appearing on such material. You may not modify the materials at this Site in any way or repost, republish, reproduce, publicly display, perform, assign, sublicense, sell or prepare derivative works of or otherwise use the materials for any purpose except as expressly permitted under this Agreement. Copyright in the materials at this Site is owned by or used with permission by RCI and any unauthorised use of any materials at this Site may violate copyright, trade mark and other proprietary (including but not limited to intellectual property) legal rights of RCI. You must not use the Site for or in connection with any activities which are fraudulent or which breach any laws or regulations. RCI may immediately suspend, terminate or limit your access to the Site without notice for any reason whatsoever at RCI's sole discretion. Without limitation to the foregoing. RCI may suspend, terminate or limit your access to the site if you are, or RCI reasonably believes or suspects that you are, in breach of these terms of use or any laws or regulations. RCI may shut down the Site at any time for any reason at RCI's sole discretion without prior notice.

EDITING, DELETING AND MODIFICATION
We reserve the right in our sole discretion to edit or delete any documents, information or other content appearing on the Site. All bigredholidays.com offers and inclusions are subject to change and may be withdrawn or amended at any time without prior notice.

LINKS TO OTHER WEB SITES
The Site contains links to other Web sites which are not created, owned or operated by RCI. RCI is not responsible for the content, accuracy or opinions expressed in such Web sites, and such Web sites are not investigated, monitored or checked for accuracy or completeness by us. Inclusion of any linked Web site on our Site does not imply approval or endorsement of the linked Web site by us. If you decide to use these links you will leave our Site and access these third-party sites, you do so at your own risk. RCI does not make any representations about third-party Web sites; or any information, other products or materials found there; or any results that may be obtained from using them.

NO WARRANTIES
The information, materials and services provided at and accessible through this site are provided as is, as availiable, and, to the maximum extent permitted by applicable law, RCI expressly disclaims all warranties, whether expressed or implied, including warranties of merchantability, fitness for a particular purpose, use, or the results of use of this site, any web sites linked to this site, or the materials or information contained at this or any such other web sites.

The information, materials and services provided at and accessible through this site may contain bugs, errors, viruses, problems or other limitations.

LIMITATION OF LIABILITY
RCI aggregate liability for damages claimed under this agreement and arising out of RCI performance of services hereunder shall be limited to the total purchase price you pay for any goods, services or information.

To the maximum extent permitted by applicable law, in no event shall RCI be liable whatsoever for your use of any information, materials or services provided at or accessible through this site. In particular, but not as a limitation thereof, RCI is not liable for any indirect, special, incidental or consequential damages (including damage for loss of business, loss of profits, litigation, or the like), whether or not reasonably foreseeable and even if RCI has been advised of the possibility of such damages and regardless of the form of action, whether in contract. Tort (including negligence), strict liability, arising under statute or otherwise. The negation of damages set forth above are fundamental elements of the basis of the bargain between RCI and you. This site and the information would not be provided without such limitations. No advice or information, whether oral or written, obtained by you from RCI through the site shall create any warranty, representation or guarantee not expressly stated in this agreement.

APPLICABLE LAWS
This Site is administered by RCI at its offices in Australia and is subject to the laws of the Commonwealth of Australia. You agree to submit to the non-exclusive jurisdiction of the courts of Australia in relation to any dispute relating to this Agreement. RCI makes no representation that materials at this Site are appropriate or available for use outside Australia and New Zealand, and access to them from territories where there contents are illegal is prohibited. You may not use, export or re-export the materials at this Site or any copy or adaptation in violation of any applicable laws or regulations.

SEVERABILITY
If any provision of this Agreement is found invalid or unenforceable, that provision will be enforced to the maximum extent permissible, and the other provisions of this Agreement will remain in force.

TERMS POLICY
Our terms Policy, as it may change from time to time, is a part of this Agreement.

Terms and Conditions - 7 Night Accommodation

HOW TO BOOK
7 Night Accommodation bookings can be made on www.bigredholidays.com or by calling bigredholidays.com on 1300 368 888 (Aus) or 0508 244 733 (NZ). Bookings are subject to availability and are restricted to specific check-in days. Non-accommodation items are subject to actual pricing at the time of booking. Any verbal quote given is an estimate only of the price, which will be subject to written advice on confirmation of the reservation from your booking agent. Accommodation Bookings may only be made through bigredholidays.com and are not available direct with any properties. Where reservations have been booked for 2 consecutive weeks at one property, a room change may apply.

PRICES AND PAYMENT
Payments must be made by credit card (Visa, MasterCard or American Express) in AUD. Payment in full is required at the time of purchase. Prices are in Australian Dollars and include GST, but do not include transport, or any items of a personal nature, meals, transfers, or existing or proposed taxes and government charges, unless otherwise indicated.

CANCELLATIONS & NO SHOWS
All amendments or cancellations need to be advised to bigredholidays.com by phone and/or in writing with receipt of acknowledgment. Cancellation and modification of Accommodation Bookings up to 30 days prior to the date the Accommodation Booking commences (Check-in Date) will incur a fee of $75. Bookings cannot be modified within 30 days of the check-in date and there will be no refund for cancelling a booking within 30 days of the check-in date or not utilizing the accommodation booked. No refund will be given once a guest has checked into a property.

COMPLAINTS
In the case of any problem or complaint about any Accommodation Booking once the accommodation stay has begun, it is imperative that you inform the property manager immediately in order for the property to endeavour to rectify the situation as quickly and efficiently as possible. If you do not do so, it may hinder the ability of the property to resolve your concerns and to ensure your stay is exactly to your liking. Any complaints should be sent in writing to bigredholidays.com Head Office (see contact details below) within 14 days of check out.

CHECK-IN & CHECK-OUT
Check-in and check-out times vary from property to property, refer to the relevant property Profile on the Website (the Property Profile). If you plan to arrive outside of reception hours, please contact the property directly. A late check-out may be arranged at the Resort for a fee and will be subject to availability.

MAXIMUM OCCUPANCY
The number of guests must not exceed the maximum occupancy level of the room type as shown in the Property Profile. Children are included in the number of guests.

BONDS
Properties may ask guests to provide a credit card imprint on arrival to cover any miscellaneous or customary charges. Where a credit card is not available, a cash deposit may be required. In addition, if requested, an acceptable form of photographic identification will need to be provided upon check-in. Fees, if any, incurred by the guest for the use of amenities at a property are determined and collected by that resort.

ROOM ALLOCATION
If bigredholidays.com cannot provide accommodation as previously confirmed, in the Accommodation Booking for whatever reason, bigredholidays.com will undertake to relocate clients into an alternative property at no expense to the client. The alternatives offered are at bigredholidays.com discretion.

TRAVEL INSURANCE
We strongly recommend you purchase comprehensive travel insurance at time of booking. We suggest that the policy should include, but not be limited to, the following cover: Loss of deposit through cancellation; loss or damage to personal baggage and loss of money and medical expenses.

PASSPORTS are required by all passengers traveling internationally and are always the responsibility of the passenger. Countries insist that your passport has at least 6 months validity beyond the date of your return to Australia.

VISAS are the responsibility of the passenger. Please advise bigredholidays.com if you are not traveling on an Australian passport, as you may require a returning resident visa. bigredholidays.com can advise on visa requirements as requested. Any previous criminal convictions or drink driving offences may require a visa application prior to departure.

VACCINATIONS
bigredholidays.com consultants are not qualified to advise on vaccinations. Please contact your local GP for advice.

DESTINATION PASSENGER ENQUIRIES
bigredholidays.com makes no representations as to the safety, conditions and other issues that may exist at any destination. Travel information can be obtained from various sources, including local governments and web sites.

GENERAL
All clients under the age of 21 must be accompanied by a parent/guardian or an individual over the age of 21. The property has the right to refuse any booking, when the legal guardian over 21 cannot provide current photo ID if requested. The person who has made a booking shall be deemed to have accepted the booking conditions on behalf of all persons named in the booking. Please contact the property directly in order to satisfy any special requirements.

RESPONSIBILITY
RCI will not be liable for any accident, injury, delay, property damage or personal loss to you or those travelling with you in connection with any Accommodation Booking, transportation, or other travel services resulting directly or indirectly from any occurrences or conditions beyond its control, including but not limited to acts of terrorism, act of God, defects in vehicles, war, strikes, theft, delay, cancellation, civil disorder, disaster, Government regulations or changes in itinerary or schedule. Whilst care is taken to ensure that the description of property facilities and services is accurate, these are continually being changed, upgraded, and on occasion taken out of service. bigredholidays.com relies on information provided by participating properties and is not responsible for the accuracy of this information. If any feature/facility is essential for the passenger in choosing a particular property, it is advisable that the guest checks this with their travel consultant at time of booking. bigredholidays.com cannot be held liable for omissions or errors, whether temporary or permanent of a property's facilities and services.

Property room photos viewed at or through www.bigredholidays.com (the Website) may not be specific to actual rooms allocated, and such photos are indicative only. Accommodation facilities listed may not apply to all room types.

If you book any travel or other product through or in connection with bigredholidays.com, that booking shall be subject to the standard terms and conditions of business of Group RCI Pty Ltd (ABN 87 093 459 646).

The terms and conditions are governed by the laws of the State of Queensland, Australia.

Terms and Conditions - Hot Deals

PAYMENT
A non-refundable deposit per person is required within 7 days, OR as specified on the invoice OR final payment is required no later than the date as specified on the invoice. Payments after this date will be subject to all increases. Payment of the deposit does not guarantee costs. Invoice costs are current at the time of printing. Payment may be made by credit card or cheque. Cheques will require 10 working days to clear before documents can be issued. Documents can not be released without receiving the signed acknowledgement of the Terms and Conditions that is attached to the credit card authorisation form. Documents will only be issued once full payment is received.

PRICES
Prices are subject to change without notice until full money is received and tickets and documents are issued in accordance with the Operators terms and conditions. Changes (including exchange rates, airfares, taxes and other land costs) may affect the costs. €˜Operators€™ include airlines, wholesalers, cruise and tour companies, etc.

RESERVATIONS
Reservations (even when accompanied by a deposit or payment) are subject to confirmation. Where reservations cannot be confirmed, you will be offered the choice of alternative arrangements or the refund of the deposit related to that particular reservation.

MEALS/SEATING
Note that bulkhead seats are reserved for families traveling with infants. Forward seating is reserved for Gold and Silver frequent flyers. Exit row seating is blocked until check-in. For all other seating requirements, your request can be made but is not guaranteed until check in and is subject to availability. Any special meals can also be requested.

AIRLINE FREQUENT FLYER NUMBERS
Ensure your travel agent has entered your membership number into your reservation. Please be aware some Airfares/Airlines are not eligible to earn points. Please check that the airline has your frequent flyer number when you reconfirm your flights AND upon check in. Keep all tickets and boarding passes until you are sure that the correct miles have been credited to your membership upon your return. These are your proof of travel €“ lose them and you lose your points. A fee of $50 applies if bigredholidays.com staff has to retrieve copied of archived tickets. Ultimately your frequent flyer membership is your responsibility. Any frequent flyer queries, should be directed to the airline concerned.

SCHEDULE CHANGES
The airlines do have the right to reschedule or cancel flights at ANY time. If you have paid in full and are holding tickets, the airline accept more responsibility to accommodating any changes made that don€™t suit you. We will do our utmost to rebook you on the closest flight time or date available, subject to seat availability. bigredholidays.com will not accept responsibility should changes occur as these are beyond our control.

INCORRECT NAMES: If the spelling is different to your passport/photo identification - PLEASE ADVISE US IMMEDIATELY. In the case of an air ticket needing to be reissued due to a name correction, a fee will be incurred. In some cases you may have to pay more for your ticket if there are no seats available to rebook in the correct name. Any fees will be the responsibility of the passenger if bigredholidays.com has not been informed of the correct name and spelling at the time of booking.

CANCELLATION
Cancellation of travel arrangements after confirmation and up to 30 days prior to departure will incur bigredholidays.com fees of a minimum as follows. Please note these will vary according to your itinerary.

Domestic - from $210 per person
International - from $410 per person

Cancellation of travel arrangements within 30 days of departure will incur 100% cancellation fee. Airline and wholesalers cancellation fees are in addition to bigredholidays.com cancellation fees and payable by you to the Operator under their terms and conditions.

AMENDMENTS AND SERVICE
After deposit has been taken, the first amendment is free of charge. Additional amendments will incur a minimum fee of $55 per person, together with any amendment fees applied by the Operator/Airlines. Service fees do apply. Please ask your travel consultant for a copy of the schedule.

PASSPORTS
Passports are required by all passengers traveling internationally and are always the responsibility of the passenger. Countries insist that your passport has at least 6 months validity beyond the date of your return to Australia.

IMPORTANT: Please forward a copy of the first page (photo) of your passport/s to bigredholidays.com prior to final payment. Documents will not be issued unless this is received.

VISAS
Visas are the responsibility of the passenger. Please advise bigredholidays.com if you are not traveling on an Australian passport, as you may require a returning resident visa. bigredholidays.com can advise on visa requirements as requested. Any previous criminal convictions or drink driving offences may require a visa application prior to departure.

CLAIMS AND REFUNDS
bigredholidays.com will assist you in advising the Operator(s) of the claim and refunds will only be issued once bigredholidays.com has received the refund amounts from the Operator(s). Note that airlines can take approx. 6 - 8 weeks to issue refunds.

THE TRAVEL AGENT is not liable to you for any act of neglect of any kind by the operator. The Travel Agent acts as the Agent for the Operator, providing the operator services. Every Operator supplies the terms and conditions on their brochures, tickets or documentation. Performance of the services is a matter between you and the Operator.

LIMITATION OF LIABILITY
bigredholidays.com acts as the agent for the Operator(s) and is not liable for the default of the principal involved. Suppliers and airlines reserve the right to cancel or amend travel arrangements at ANY time.

TAXES
Australian departure tax is recorded on your ticket as being paid. All quoted taxes are subject to change until tickets are issued. However, there are still some countries where taxes are paid upon departure from the airport.
